The contract is concluded when we confirm your order or ship the goods .

4. Prices and Payment Terms

All prices are quoted in euros (€) and include the legally applicable value added tax , if any.

The customer is only entitled to set-off or retention if his counterclaim has been legally established or is undisputed .

Commercial customers are not entitled to a voluntary right of withdrawal.

7. Retention of title

The goods remain our property until full payment has been received.

8. Warranty

The statutory warranty rights apply .

For used goods sold to commercial customers, the warranty period is 12 months , provided that such a reduction is legally permissible.

Consumers are subject to the statutory warranty periods .

9. Liability

We are fully liable in cases of intent and gross negligence.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations (so-called cardinal obligations) and limited to foreseeable, typical contractual damages.

11. Jurisdiction and applicable law

The law of the Federal Republic of Germany shall apply , excluding the UN Convention on Contracts for the International Sale of Goods (CISG), insofar as this choice of law is legally permissible.

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the registered office of Pitbulltdc , insofar as legally permissible.

12. Final Provisions

Should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected .

The place of performance is – to the extent legally permissible – the registered office of Pitbulltdc.
